Terms of Sale
of Gepe Produkte AG (Gepe)
1. Contract scope GEPE Produkte AG (Gepe) hereby sells to the customer the goods specified in the online store under the general sales conditions as specified below.
2. Entering into a contract In order for a contract to be entered into between the customer and Gepe, the order submitted by the customer must first be accepted by Gepe. The customer places his order via Internet. Gepe accepts the order either: (a) by sending the customer an order confirmation via fax, e-mail or normal mail, or (b) by delivering the goods to the customer with an invoice.
3. Product offerings Any details that the customer receives about the goods during the order process are not binding. This includes modifications to product design and technology, which improve the product's functionality, as well as errors in the product description, illustrations, and pricing details.
4. Payment conditions Prices are in EURO (€) excluding value-added tax (VAT), shipping and packaging costs from our warehouse in Farchant, Germany. Shipping and packaging costs are charged separately. The goods have to be paid in advance by credit card (VISA or Mastercard).
5. Delivery conditions Products will normally be delivered from our warehouse within 3 workdays to the address provided by the customer. If products are out of stock, the customer will receive a written order confirmation stating the probable delivery date. Goods are delivered from the loading dock at the customer's own expense and responsibility. This is also applicable for partial deliveries. All shipments are accompanied by an invoice, which states the contents and description of the items and the value of the shipment. The customer is responsible for any charges for customs clearance, import duties, taxes, VAT and similar. Customs policies and fees vary from country to country and to find out what they may be in your country, you have to contact your local customs office for information.
6. Complaints / Returns Gepe will only accept claims within 7 days of delivery and if the goods have been damaged during transportation, the complaint must be accompanied by a certificate of damaged goods, issued by the shipping company. If goods are to be returned, they must also be accompanied by a valid Return Authorization Code, which can be obtained by contacting us by e-mail. Note that we are not responsible for returns lost by the shipping company.
7. Intellectual property Gepe owns the rights to every design, text and graph on its web site. Making a copy or any kind of reproduction of either the entire web site or parts thereof may be made strictly for the purpose of submitting an order to Gepe. The Gepe name, all page headers, navigation bars, graphs and display symbols are registered trademarks, brands or protected brands of Gepe. All other trademarks product or company names or logos which are displayed on the web site are the sole property of their legitimate owner. Gepe retains the property rights and copyrights to all illustrations, drawings, calculations and other documents. Before transferring such items to a third party, the customer must request Gepe's explicit agreement in writing.
8. Data protection Gepe ensures adherence to the regulations of the data protection laws of Switzerland and the relevant legal standards when inquiring, administering and using person-related data. Customer related data gathered for order processing is used solely for internal market research purposes. Transfer of such data to third party partner organizations will occur only when absolutely necessary for proper delivery of services (e.g., for order processing). The customer hereby declares himself in agreement with said use of his personal data. In general, the customer has the right at any time to request to see his personal data, which has been saved by the company and to forbid the use of such data for internal market research purposes.
9. Legal jurisdiction and applicable law These general sales conditions (GSC) and any contracts entered into under this GSC are subject to Swiss law excluding UN purchase rights (CISG). Legal jurisdiction is Zug, Switzerland.
10. Concluding requirements Sales of Gepe products which are specified in the online shop are covered exclusively by the version of the general sales conditions (GSC) that is valid at the point in time the contract is entered into. Should individual requirements be or become invalid, this has no impact on the legal applicability of the remaining general sales conditions (GSC). In general, Gepe reserves the right to make changes at any time to these general sales conditions (GSC).
